By installing or using the SEEK Downloadable Search Box (SEEK Search Box) you agree to be bound by the following terms and conditions. The SEEK Search Box refers to the SEEK (seek.com.au) Downloadable Search Box software and all associated third party software used in the SEEK Search Box.
Intellectual Property
SEEK or its licensors own all rights, title and interest in and to the SEEK Search Box; this includes all intellectual property rights. You agree not to infringe any intellectual property rights owned by SEEK or its licensors. SEEK agrees not to infringe any intellectual property rights on your own Website.
You must not modify, translate, adapt, reverse engineer, decompile, disassemble, or prepare derivative works from, or otherwise attempt to derive source code from the SEEK Search Box, for your own use or for sale or transfer to third parties. The SEEK Search Box should only be installed if it has been downloaded directly from the SEEK website. SEEK cannot guarantee the security of the SEEK Search Box if it has been downloaded from other sources.
Functionality
SEEK reserves the right to alter, amend or otherwise change the design and functionality of the SEEK Search Box, without requiring your permission.
Termination
SEEK reserves the right to request the removal of the SEEK Search Box from your website, for any reason whatsoever, and you agree to remove the SEEK Search Box within 24 hours. You may remove the SEEK Search Box from your website by giving SEEK 24 hours notice.
SEEK Job Search Services and Privacy Policy
The SEEK Search Box is designed to be used in conjunction with the seek.com.au job search service. As such, your use of the SEEK Search Box is also governed by SEEK's Terms and Conditions of Use and Privacy Policy for the seek.com.au job search service.
Information Collection
The SEEK Search Box does not collect any information regarding your internet and computer use, or personally identifiable information.
If there is any change to this policy, and the functionality of the SEEK Search Box is changed to collect such information, SEEK will notify you of the changes, and give you the opportunity to accept or reject the new version.
Disclaimer of Warranties
The SEEK Search Box is provided "as is", without any warranties of any kind either expressed or implied, to the fullest extent permissible pursuant to applicable law. You download, install and use the Search Box at your own risk.
Limits on Liability
SEEK and their licensors will not be liable to you or any other parties in respect of any loss or damage, including for negligence, (whether indirect, special, or consequential loss or damage such as loss of revenue, disruption or unavailability of systems or loss of data) arising from, or in connection with, any download, installation or use of the SEEK Search Box for any reason whatsoever.
Where a statute implies a term into any arrangement arising out of your use of the SB, and that statute prohibits exclusion of that term, then that term is included. However, if SEEK and their licensors' liability for breach of a term is capable of limitation, that liability is limited to the re-supply of the SEEK Search Box.
General Provisions
If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable.
Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.
The laws governing this agreement will be the laws in Victoria, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in Victoria.
